Understanding the Chemicals and Compliance Timeline

The Proposition 65 warning list includes more than 900 chemicals, ranging from naturally occurring substances to synthetic compounds. These chemicals are commonly found in manufacturing, construction, and may also be byproducts of chemical processes, such as motor vehicle exhaust. Once a new chemical is added to the list, manufacturers have 20 months to update labeling and implement any necessary changes.

Recent Updates to Proposition 65 Requirements

Although Proposition 65 has been in effect since 1986, recent amendments have imposed stricter requirements, effective August 30, 2018. These updates mandate that warnings must be more explicit - fully identifying the specific chemical and detailing how exposure may occur, along with ways to reduce or eliminate the risk. The warning symbol, required by the regulation, must appear to the left of the warning text and be no smaller than the height of the word “WARNING.” Penalties for non-compliance can be as high as $2,500 per violation per day.
